Lesson 5: Other Constitutional Commissions

Background: 

In order to manage different significant issues and agendas, the constitution of Nepal has maintained the provision of 'constitutional commissions'. In part 27 from article 252 to 264, the provision of seven commissions are made. They are;

1.     National Women Commission:

     The President, on the recommendation of Constitutional Council, appoints a Chairperson and other four members. The term of office of the chairperson of National Women Commission is of 6 years.

Functions of National Women Commission:

a.    To formulate national policy and program concerning the right and of woman,

b.   To suggest the government of Nepal and monitor whether or not the existing law relating to the right and interest of woman is implemented

c.  To include woman ensure women’s participation in the mainstream of national development,

d.   To file cases against any violence against woman and others.

2.     National Dalit Commission:

The President, on the recommendation of Constitutional Council appoints a Chairperson and the other four members. The term of office of the chairperson of National Dalit Commission is of 6 years.

Functions of the National Dalit Commission:

a.     To research and prepare necessary policy for reform in the Dalit community,

b. To end caste-based discrimination and include the Dalit community in the mainstream of national development,

c. To file the cases against any matters of being victims of cast-based discrimination and untouchability,

3.     National Inclusion Commission: The President, on the recommendation of              Constitutional Council, appoints a Chairperson and other four members. The term of office of the chairperson of National Inclusion Commission is of 6 years.

      Functions of National Inclusion Commission

a.     To research and protect rights of Khas Arya, minorities, a person with a disability, senior citizens, labours, backward class, people of Karnali and indigent class.

b.     To suggest the government about the plans and policies for the development and uplift of community, people and class mentioned above,

c.   To study the status of implementation of the policies and laws adopted by the government for the inclusion of community, class and region mentioned above.

4.     Indigenous Nationalities Commission:

In the article 261of the constitution of Nepal, the President, on the recommendation of Constitutional Council, appoints a Chairperson and maximum of the other four members. The term of office of the chairperson of Indigenous Nationalities Commission is of 6 years.

5.     Madhesi Community:

In article 262 of the constitution of Nepal, the President, on the recommendation of Constitutional Council, appoints a Chairperson and maximum of the other four members. The term of office of the chairperson of Madhesi Community is of 6 years.

6.     Tharu Community:

In article 263 of the constitution of Nepal, the President, on the recommendation of Constitutional Council, appoints a Chairperson and maximum of the other four members. The term of office of the chairperson of Tharu Community is of 6 years.

7.     Muslim Commission:

In article 264 of the constitution of Nepal, the President, on the recommendation of Constitutional Council, appoints a Chairperson and maximum of the other four members. The term of office of the chairperson of Muslim Commission is 6 years.

(Indigenous Nationalities, Commission Madhesi, Community, Tharu Community and Muslim Commission study and research the policy and programs for the protection and uplift of rights of their concerned communities, class and region and suggest the government for the plans of policies for the preservation of rights of their concerned communities.)
